Missouri voters passed Amendment 3 on November 8, 2022, legalizing recreational cannabis for adults 21 and older. The amendment took effect December 8, 2022, making Missouri one of 24 states with legal adult-use cannabis. The Division of Cannabis Regulation (DCR) oversees all licensing, testing, and enforcement.

• Up to 18 grams of concentrate
• Up to 3,000mg of THC in infused products (edibles, etc.)

• Adults 21+ may grow up to 6 cannabis plants at home
• Plants must be in a locked space not visible to the public
• Cannot be visible from a public place
• Cannot cultivate more than 6 flowering plants at one time
• Home grow is for personal use only — not for sale

Legal:

• Private residence (with property owner permission)
• Licensed cannabis consumption lounges

Illegal:

• Public spaces, streets, parks
• Vehicles (driver OR passenger)
• Schools, daycares, school buses
• Correctional facilities
• Any property where owner prohibits it

• It is illegal to drive under the influence of cannabis in Missouri
• Missouri has no per se THC limit (unlike alcohol's .08 BAC)
• Officers use field sobriety tests and drug recognition experts
• DUI cannabis carries the same penalties as alcohol DUI
• THC can remain detectable in blood/urine long after impairment ends

• Missouri employers CAN still drug test employees
• No state law protects employees from termination for cannabis use
• Exception: medical patients have some protections in certain situations
• Federal employees remain subject to federal drug-free workplace rules

• Recreational: must be 21+
• Medical: 18+ (under 18 requires caregiver/guardian)
• Purchase from licensed dispensary only

• Missouri allows licensed cannabis consumption lounges
• Must be 21+ to enter
• Cannot sell alcohol alongside cannabis

• Possession over legal limits: Class D felony (>35g recreational)
• Public consumption: Class A misdemeanor, up to $500 fine
• Distribution without license: serious felony charges
• Underage possession: Class D misdemeanor
